Q: Can borrowers pay off debt as part of the transaction?

A: In most cases, the only debt that can be paid off in closing is liens against the property. However, there are a few small exceptions; one is a court order (typically a divorce settlement of some type). The last items which are the most popular question is consumer debt, credit cards, etc. The answer to that is no. You cannot pay off debt to qualify the cash flow residual standard; however, we can utilize that as a “compensation factor” in determining the overall underwriting decision.
